Terms of Use
Effective October 13, 2026 · Version 2026-10-13
Operator and scope
ExamKinetics AI is operated by Manish Bakshi, an individual business operator in the United States. These terms describe the conditions for using the service. Our Privacy Policy explains data practices; our Subscription and Refund Policy describes paid purchases. Paid checkout requires affirmative acceptance of the applicable version of these terms and the billing policy. If you do not agree, do not purchase or use the service.
Adult educational use
You must be at least 18 years old and able to enter into the applicable agreement. ExamKinetics provides study and practice tools, not medical advice, patient care, professional certification, or an official examination. It does not guarantee exam success, score increases, admission, employment, or clinical competence. See the Educational and AI Disclaimer.
Your account
Use your own authorized account, provide accurate information when requested, and protect access to your devices and ChatGPT account. Do not share access to bypass limits or use another person's account without authorization. Sign-in and payment services have separate provider terms. Notify us through Contact if you suspect unauthorized activity.
Your materials and intellectual property
You retain whatever rights you hold in material you submit. You give us the limited permission needed to host, synchronize, process, display, and send that material to service providers for the features you request. This permission does not give us a general right to publish your private question bank or use it in an optional research study.
Submit only material you own or are legally permitted to use and process through this service. Access to a question-bank subscription or a copy of an exam does not by itself give permission to upload, reproduce, redistribute, or commercially exploit it. Do not upload leaked exam questions, confidential examinations, or materials contrary to their license or applicable law. A private workspace does not establish copyright permission. Public community contribution is not enabled by these terms.
Our interface, branding, and original service materials remain subject to their applicable intellectual-property rights. You receive permission to use them for authorized study through the service, not to copy or resell the service. AI output may be inaccurate, similar to other output, or subject to third-party rights; we do not guarantee its originality or copyright protection.
Acceptable use
Do not introduce malicious code, bypass access controls, scrape restricted content, interfere with other users, evade allowance or payment limits, use the service for unlawful activity, impersonate someone, or upload sensitive patient records. Do not use the tool to obtain unauthorized assistance during an exam. We may restrict access reasonably needed to prevent abuse, address legal obligations, or protect the service.
Beta availability and paid features
This is a developing beta. Features, limits, supported models, and availability may change, and interruptions or errors can occur. Keep independent copies of important study material. Current free beta practice does not imply a permanent entitlement to all future features. A paid purchase covers the features disclosed when purchased; we will not silently substitute materially different paid terms. If we discontinue a paid service, contact us about applicable refunds, including unused purchased AI credit.
Payments, restrictions, and termination
Purchases, renewal, cancellation, AI credit, and refunds are governed by the Subscription and Refund Policy. Canceling renewal preserves paid access through the paid period. We may suspend abusive or unlawful use; suspension does not erase statutory rights or automatically forfeit unused purchased credit. Contact us to resolve payment or access problems. Deletion of data and termination of renewal are separate actions.
Limitations and your legal rights
To the extent permitted by applicable law, the beta and its outputs are provided as available without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or guaranteed educational results. You remain responsible for verifying important information and complying with professional and exam rules. Nothing here excludes liability that cannot legally be excluded, waives mandatory consumer rights, or prevents remedies required by law. These terms do not impose mandatory arbitration or a class-action waiver.
Changes and contact
We identify terms by their effective date and retain the version accepted for a purchase. Material changes affecting a paid agreement will receive notice and renewed acceptance where required; a website update does not retroactively rewrite a completed purchase. Questions, disputes, and copyright concerns can be submitted through Contact. For a copyright concern, identify the work, the relevant page or material, your authority to raise the concern, and a reply address. This contact process is not a representation that the service has registered a statutory DMCA agent.
